TRUSTEE’S NOTICE OF SALE
Reference is made to that certain trust deed made by Sandra Harley as grantor, to Amerititle of Ontario, Oregon, as trustee, in favor of William E. Mackenzie and Christine A. Mackenzie, husband and wife, as beneficiary, dated June 25, 2009, recorded July 7, 2009, in the mortgage records of Malheur County, Oregon, as Instrument No. 2009-5172, which Trust Deed was assigned to Christine A. Mackenzie, nka Christine A. Pond, by an Assignment of Trust Deed dated January 27, 2014, and recorded in the official records of Malheur County, Oregon, as Instrument No. 2014-0526 on February 20, 2014, covering the following described real property:
Land in the City of Ontario, Malheur County, Oregon, within the E1/2SW1/4NE1/4NE1/4 of Section 5, Twp. 18 S., R. 47 E., W.M., as follows:
Beginning at the Southwest corner of said E1/2SW1/4NE1/4NE1/4; Thence N. 0 degrees 04’43” E., along the West line of said E1/2SW1/4NE1/4NE1/4, a distance of 187.64 feet; Thence S. 89 degrees 53’26” E., parallel with the South line of said E1/2SW1/4NE/1/4NE1/4, a distance of 106.66 feet to a point on the West right of way of Triand Drive as per the Plat of Pheasant Ridge Estates; Thence S. 0 degrees 06’07” W., along said right of way, a distance of 187.64 feet to a point on the South line of said E1/2SW1/4NE1/4NE1/4; Thence N. 89 degrees 53’ 26” W., a distance of 106.58 feet to the Point of Beginning. EXCEPTING THEREFROM the following described parcel:
Commencing at the Southwest corner of said E1/2SW1/4NE1/4NE1/4; Thence N. 00 degrees 04’43” E., along the West line of said E1/2SW1/4NE1/4NE1/4, a distance of 30 feet to a point of the North Right of way line of Hunter Lane; Thence S. 89 degrees 53’ 26” E., parallel with the said North right of way line, a distance of 76.59 feet to the POINT OF BEGINNING; Thence continuing S. 89 degrees 53’ 26” E., a distance of 30 feet, to a point on the West right of way of Triand Drive as per the Plat Pheasant Ridge Estates; Thence N. 00 degrees 06’07” E., along said right of way, a distance of 397.64 feet; Thence N. 89 degrees 53’ 26” W., a distance of 10 feet; Thence S. 00 degrees 06’07” W., parallel with and 10 feet west of said west right of way of Triand Drive as per the Plat of Pheasant Ridge Estates, a distance of 377.64 feet to the beginning of a 20 foot radius curve to the right; Thence along said curve to the right, a distance of 31.42 feet, whose long chord bears S. 45 degrees 06’20” W., 28.29 feet, to the Point of Beginning; FURTHER EXCEPTING that certain right of way known as Triand Drive described as a private right of way in the Plat of the Pheasant Ridge Estates filed in the Books of Deeds and Records for the County of Malheur State of Oregon on March 26, 1996, as Instrument No. 96-2136, Malheur County Records.
Both the beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.752(3); the default for which the foreclosure is made is grantor’s failure to pay when due the following sums: Monthly payments of $1,264.00 each beginning January 7, 2017, and continuing each month until this trust deed is reinstated or goes to trustee’s sale; plus the sum of $563.00 paid for foreclosure report; $181.00 for recording fees, plus all attorney’s fees and all other fees, costs and expenses associated with this foreclosure and all sums expended by the beneficiary to protect the property or his interest therein during the pendency of this proceeding.
By reason of this default, the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, which sums are as follows: The sum of $144,306.77 with interest thereon at the rate of 7% percent per annum from January 12, 2017, until paid; plus reimbursement to the beneficiary for foreclosure report paid by the beneficiary in the amount of $563.00; plus $181.00 in recording fees, plus all attorney’s fees, and other fees, costs and expenses associated with this foreclosure and all sums expended by the beneficiary to protect the property or her interest therein during the pendency of this proceeding.
WHEREFORE, notice hereby is given that the undersigned trustee will on October 11, 2017, at the hour of 11 o’clock a.m., in accordance with the standard of time established by ORS 187.110, at the front door of the Malheur County Courthouse, 251 B Street West, in the City of Vale, Malheur County, Oregon, sell at public auction to the highest bidder for cash the interest in the above described real property which the grantor had or had power to convey, at the time of the execution by him of the trust deed, together with any interest the grantor or his successors in interest acquired after the execution of the trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.778 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by rendering the performance required under the obligation or trust deed, and in addition to paying the sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.778.
Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a Trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the Trustee’s sale.
In construing this notice, the masculine gender includes the feminine and the neuter, the singular includes the plural, the word “grantor” includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words “trustee” and “beneficiary” include their respective successors in interest, if any.

PUBLIC NOTICE: Vale District Bureau of Land Management (BLM) Programmatic Shrub Restoration Environmental Assessment and Decision Record

The Vale District BLM, has completed for public review, an Environmental Assessment (EA), Finding of No Significant Impact (FONSI), and a Decision Record (DR), that authorizes the implementation of shrub planting treatments within native plant communities that have the potential for restoration and/or improvement of sagebrush steppe landscapes on public lands administered by the BLM.

NOTICE OF INTENT TO IMPOUND UNAUTHORIZED LIVESTOCK
Unauthorized domestic horses have been found on public lands administered by the Bureau of Land Management in the Red Hills Allotment (10302), North Star Mountain Allotment (00310), South Star Mountain Allotment (00309), Three Fingers Allotment (10503), and Board Corrals Allotment (10507), located in the northern portion of the Malheur Field Office. The unauthorized use consists of a number of unidentified domestic horses. Any unauthorized presence of domestic horses found on the aforementioned lands are considered to be in trespass.
Notice is hereby given that unauthorized domestic horses found on public lands administered by the Bureau of Land Management in the above described allotments may be impounded without further notice any time in the 12-month period beginning 5 days from the publishing and posting of this notice.
The owners of impounded domestic horses, if identifiable upon impoundment, will be notified and may redeem their animals at a time and place specified in their notification. Before the owners will be permitted to redeem and regain possession of animals, they must pay to the Bureau of Land Management charges and expenses incurred in the gathering, pasturing, feeding, and advertising thereof.
This notice is authorized under 43 CFR 4140.1(b)(1)(i), 4150.4-1, 4150.4-2, 4150.4-3, and 4150.4-4.
