NOTICE IS HEREBY GIVEN on September 6, 2017 the Circuit Court of the state of Oregon for Malheur County in the above captioned case entered an “Order Appointing CFO Solutions, LLC as Custodial Receiver Over the “Rabo Loan Collateral,” and Issuing an Injunction in Aid of the Receivership (the “Order”). This Notice is provided pursuant to Section 33 of the newly adopted Oregon Receivership Code.
The Order appoints CFO Solutions, LLC as receiver (the “Receiver”) over all assets of the Receivership Estate, to serve until further order of the Court for the purposes described in the Order, including, but not limited to, taking control of the Receivership Estate with the power and authority to preserve, protect, and liquidate those assets and distribute proceeds to the party or parties legally entitled thereto.
A. Do not file claims at this time.
The Receiver has not yet made a determination as to whether or not funds will be available for unsecured creditors after payment of the fees and costs of the receivership and amounts owed to secured creditors. Therefore, unsecured creditors do not need to file a claim unless and until you receive a further notice to do so. No claims may be submitted until a claims process is first established by the Receiver. If the Receiver later determines that there will be assets available to pay unsecured claims, then unsecured creditors will receive further notice of a claims filing deadline and instructions how to file a claim at that time.
